1. Promotion Dates
These rules (the “Official Rules”) govern the Classic Hits 93.1 WNOX Make it Easy to Take it Easy Contest Giveaway (“Promotion”) which will begin onFebruary 12, 2018 at or around 9:00 a.m. ET and end on March 13, 2018 at or around 8:00 p.m. ET.
2. ELIGIBILITY RESTRICTIONS
a. The Promotion is open to all legal residents of the United States and the District of Columbia who are 21 years of age or older at the time of entry and who live in Tennessee (the “Promotion Area”) within the terrestrial broadcast over the air signal of 93.1 WNOX. Employees of Scripps Media, Inc., d/b/a WNOX-FM, (the “Promoter” or “Station”), Pelancho’s Mexican Grill, A-1 Finchum Heating and Cooling, their respective corporate parents, subsidiaries, and affiliated entities, Promoter’s advertising agencies, participating sponsors/promotional partners, other broadcasting stations in the Knoxville metropolitan area, and the members of those individuals’ immediate families (spouse, parents, siblings or children) or households (whether related or not) are ineligible to participate or win. Void where prohibited and outside the Promotion Area.
b. Individuals may win a Promoter contest or promotion only once every 60 days, including all contests or promotions conducted by WWST-FM/Star 102.1, WCYQ-FM/Q100.3, WNOX-FM/93.1 and WKHT-FM/HOT 104.5.
c. Entrants are required to provide truthful information and Promoter will reject and delete any entry that it discovers to be false or fraudulent. Promoter will disqualify any entry from individuals who do not meet the eligibility requirements.
To participate in the Promotion, you may enter via the following methods:
A. VIA TELEPHONE – Entrants must listen to the Station each weekday beginning on February 12, 2018 and ending on March 9, 2018 for songs performed by The Eagles. Songs will be played starting at 9:00 am ET and through 4:30 pm ET. There will be between one and seven Eagles songs played between those hours. Around 4:40 pm ET each weekday afternoon, the DJ will ask for the 9th caller at 865-656-9393 to name by title an Eagles song we played that day at any time between 9 am and 4:30 pm ET on the Station. If the fifth caller after the announcement (the “Caller”) (determined in the sole discretion of Station) does so correctly, the Caller will win a Qualifying Prize and, upon confirmation of eligibility, will qualify for a chance to win the Grand Prize (each such qualifier deemed a “On-Air Qualifier”) at the “Grand Prize Event” on Tuesday, March 13, 2018 at 7:00 pm ET at Pelancho’s Mexican Grill at 1516 Downtown W Blvd. in Knoxville, TN (“Sponsor”). If the Caller can name more than one Eagles song the Station has played that day between 9 am and 4:30 pm ET, the Caller will get another entry into Grand Prize drawing at the Grand Prize Event for each song we played that the Caller can correctly identify, but still only one Qualifying Prize. If the Caller can correctly name every Eagles song the Station played that day during the timeframe identified above, the Caller will get a the number of correct answers doubled, therefore doubling the number of entries the On-Air Qualifier will have at the Grand Prize Event. If the Caller cannot identify a single song, the next caller to the contest line will be designated a Caller and will have an opportunity to identify the songs. At the time of their call, entrants must provide all requested information, including, their first name and last name, complete address, city, state, zip code, email address, telephone number, and date of birth. Use of any device to automate entry is prohibited. The Promotion administrator’s telephone system is the official time keeping device for the Promotion. If the selected caller is disconnected or is found to be ineligible, the next eligible caller who successfully makes it through on the call-in line and completes the call will win a Qualifying Prize and be deemed an On-Air Qualifier. There is no limit to the number of times a listener may attempt to call in to qualify, but a listener may be an On-Air Qualifier only once. Up to 20 On-Air Qualifiers will be selected. On-Air Qualifiers will be notified of their status at the time of their phone call.
B. VIA ON-SITE AT GRAND PRIZE EVENT – To enter to be a qualifier on-site at the Grand Prize Event, entrants must be present at the Grand Prize Event. Entries will be accepted from 5:30 pm ET to 7:00 pm ET. Entrants must legibly hand write their first name and last name, complete address, city, state, zip code, telephone number (including area code), and date of birth on an official entry form (while supplies last) and place the completed entry form in the dedicated collection box. P.O. Boxes are not permitted. Entries submitted may not be acknowledged or returned at the Grand Prize Event. Failure to provide all required information may result in disqualification.
Up to five additional qualifiers (the “Event Qualifiers”) will be selected at approximately 6:55 pm ET via a Station-conducted random drawing from all eligible entries received. The Station reserves the right to select additional Event Qualifiers if any of the original On-Air or On-Site Qualifiers did not check-in with Station personnel for the Grand Prize Event by 6:55 pm ET. The Station will announce the additional Event Qualifiers on-site immediately following the drawing. The potential Event Qualifiers will have 30 seconds to present themselves to Station personnel following the initial announcement. If a selected Event Qualifier is not present or fails to come forward within 30 seconds, another Event Qualifier will be chosen at random from among all eligible on-site entries remaining. This process will continue until there are a total of up to 25 total Qualifiers present. (Collectively, On-Air Qualifiers, On-Site Qualifiers, and Event Qualifiers will be referred to as “Qualifiers.”)
C. GRAND PRIZE DETERMINATION – All Qualifiers (including On-Air Qualifiers and On-Site Qualifiers) must be present at the Event to claim their Qualifying Prize and be eligible to win the Grand Prize. Certain On-Air Qualifiers may have more entries in the Grand Prize drawing because they identified more than one Eagles song correctly at the time of their call. Such On-Air Qualifiers will not be eliminated until the last entry bearing their name is chosen in the reverse drawing as described more fully below. Qualifiers who are not present at the Grand Prize Event will not be eligible to claim their Qualifying Prize and will not be part of the Grand Prize drawing. One Grand Prize winner will be selected from all Qualifiers who are present at the Grand Prize Event. All On-Air and On-Site Qualifiers must be registered with Station personnel by 6:55 pm ET. Qualifiers who register late will not be eligible to receive their Qualifying Prize or be eligible for the Grand Prize drawing. No proxies will be permitted. The Station will then begin to randomly select names of the Qualifiers present in a reverse drawing, until only one name remains, and that Qualifier will be named the Grand Prize winner. No substitutions among Qualifiers will be permitted, and an individual cannot receive more than one Qualifier position for the Event.
If no Grand Prize winner is determined, the Station will determine the Grand Prize winner in a random drawing from all eligible Qualifiers.
- Up to 20 Qualifying Prizes will be awarded. Each Qualifying Prize is a $25 gift card to Pelancho’s Mexican Grill. Approximate Retail Value (“ARV”) of each Qualifying Prize is $25. Limit one Qualifying Prize per person.
b. One Grand Prize will be awarded. The Grand Prize is a two tickets to see the Eagles perform at Bridgestone Arena on March 24, 2018 (the “Show”) in Nashville, TN and a $250 VISA gift card. ARV of Grand Prize is $750.
Once the Grand Prize is awarded, no substitutions will be made. Certain travel restrictions may apply. All other costs not specifically stated herein, including but not limited to taxes, meals, tips and ground transportation to/from the hotel, are the responsibility of the winner. The winner and guest must travel on the same itinerary and are responsible for obtaining all required travel documents, including, without limitation, passports for international travel. If applicable, the winner may be required to present a valid credit card upon hotel check in to cover any incidental expenses incurred during the winner’s stay. If the Show does not take place as scheduled, for reasons such as cancellation, preemption, postponement or unavailability, or for any reason beyond the control of the Promoter, Promoter may award the winner the remaining available portion of the prize and no substitution or compensation will be provided for the unawarded portion of the prize. Seat location at the Show is in the sole discretion of Promoter. Guest of winner who is a minor must be accompanied at all times by parent or legal guardian.
c. All prizes are awarded as-is. There is no substitution, transfer, or cash equivalent for prizes, except that Promoter may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities, or any other expenses. Promoter is not responsible for winners’ limitations that prevent acceptance, use, or nonuse of prize. Entrants acknowledge that the Released Parties, as defined herein, have not made, nor are in any manner responsible or liable for, any warranties, representations or guarantees, and hereby disclaim any and all warranties expressed or implied, in fact or in law, whether now or hereafter enacted concerning any prize, including without limitation, implied warranties of quality, merchantability, mechanical condition, or fitness for a particular purpose, except for any express manufacturer’s warranty as may be included with the prize or as may be separately provided to participants by law.
d. Any prize tickets are subject to the terms and conditions as set forth by the issuer of the tickets. Such tickets are not refundable or transferable, and may not be substituted or exchanged for cash or credit at any time, nor will such tickets be replaced if unused, lost, stolen, or damaged.
5. WINNER SELECTION AND NOTIFICATION
a. All decisions of Promoter management with respect to the Promotion are final.
c. Odds of being named an On-Air Qualifier depend upon the number and order of calls received each weekday. Odds of being named an On-Site Qualifier or Event Qualifier depend upon the number of eligible entries received for each drawing. Odds for a Qualifier winning the Grand Prize depend on the number of eligible entries at the Grand Prize Event and the number of entries that Qualifier has.
d. Qualifiers who participate on-air must listen to the Station to become a Qualifier. On-site and Event entrants must be present to enter and to become a Qualifier, but need not listen to the Station. All Qualifiers must be present at the Grand Prize Event in order to win the Grand Prize, but need not listen to the Station.
e. Qualifiers may be required to execute and return any required affidavit of eligibility and/or liability/publicity release (TN residents need not sign publicity release) and provide required identification either prior to or at the Event. If any Qualifier, fails to provide required identification and documents by the deadline set forth above, or if Qualifier is not in compliance with the Official Rules (including eligibility requirements), potential Qualifier will be disqualified and Promoter may choose an alternate Qualifier by random drawing from among remaining eligible entries at the Event.
f. Grand Prize winner must provide any required identification and execute and return any required affidavit of eligibility and/or liability/publicity release within 48 hours of winner announcement and prior to receipt of prize. If a potential Grand Prize winner cannot be contacted, cannot take the Grand Prize trip on the designated dates, fails to provide required identification and documents by the deadline set forth above, or is not in compliance with these Official Rules (including eligibility requirements), potential winner will be disqualified and will forfeit the prize, and Promoter may choose an alternate winner by random drawing from among all remaining Qualifiers. Guest of winner (and parent or legal guardian of guest who is a minor) must sign and return a Publicity, Liability Waiver and Travel Release form prior to joining winner on prize trip.
g. The Grand Prize certificates may be picked up at the office of the Promoter at the address below during regular business hours or at the Grand Finale Event. The Grand Prize winner will forfeit the prize if it is not claimed within five days of winning. Prize or prize certificates will not be mailed to the winner without the winner’s prior written consent in which the winner shall agree to assume its risk of loss. The Promoter, its sponsor, or promotional partner are not responsible for the safe arrival of a prize or prize certificate.
a. Payments of all federal, state and local taxes are solely the responsibility of the winners. Winners will be required to complete and submit an IRS Form W-9 or the equivalent including the winner’s full Social Security Number for receipt of any prize valued at $600 or more or for any prizes awarded by Promoter in a calendar year with an aggregate value of $600 or more.
b. Participating in the Promotion and acceptance of any prize constitutes each entrant’s and winner’s (and guest’s where applicable) permission for the Promoter or its agents to photograph, film, record that entrant, winner, or guest and to use his or her name, city, state, voice, or likeness, and any statements made by him or her regarding the Promotion or Promoter for purposes of trade, publicity or promotion without additional financial or other compensation.
c. Prior to awarding any prize or prize certificate, and depending on the nature of the prize and eligibility requirements of the Promotion, the Promoter in its sole discretion will require verification of Promotion winner’s identification by a showing of valid government-issued photo identification. By entering, participating and/or accepting a prize in the Promotion, each entrant, winner, and guest if applicable, agrees not to sue and to release, discharge, indemnify, hold harmless, and absolve the Promoter, Sponsor, Prize Providers, its sponsors and promotional partners, its advertising and promotion agencies and each of their respective parent, subsidiary and affiliated entities and the officers, shareholders, directors, employees, agents, and representatives and the successors and assigns of each of them (the “Released Parties”) from and against any and all claims, demands, actions, suits, losses, expenses, costs, damages, and liabilities including, without limitation, interest, penalties, court costs and reasonable attorneys’ fees and expenses arising directly or indirectly from the prize or participation in the Promotion, including, but not limited to, personal injury, death, or damage to or loss of property, which may occur in connection with, preparation for, travel to, or participation in Promotion, or possession, acceptance and/or use or misuse of prize or participation in any Promotion-related activity, including but not limited to any claims based on publicity rights, defamation, or invasion of privacy and merchandise delivery. Except where prohibited, by entering the Promotion, each entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prizes will be resolved individually, without resort to any form of class action, and the state or federal courts situated in Hamilton County, Ohio will be the exclusive venue for any such action; (ii) any and all claims, judgments and awards will be limited to actual out-of-pocket costs incurred, but in no event will such costs include attorneys’ fees; and (iii) no punitive, incidental, special, consequential or other damages, including, without limitation, lost profits may be awarded (collectively, “Special Damages”). Further, by entering the Promotion, each entrant waives all rights to claim Special Damages and all rights to have such damages multiplied or increased.
d. Promoter, in its sole discretion, reserves the right to disqualify any person (and all of their entries) from this Promotion if he or she tampers with the entry process, the operation of the Promotion, or is otherwise in violation of the Official Rules or direction of Promoter. If a dispute arises regarding compliance with these Rules, Sponsor may consider, in its sole discretion, data reasonably available to Sponsor through information technology systems in Sponsor’s control, but Sponsor will not be obligated to consider any data or other information collected from any other source. Promoter’s failure to enforce any term of these Official Rules will not constitute a waiver of this provision. If there is any conflict between the terms of these Official Rules and any marketing or entry materials used in connection with the Promotion, the terms of the Official Rules will govern. If due to circumstances beyond the control of Promoter, any competition or prize-related event or travel is delayed, rescheduled, postponed or cancelled, Promoter reserves the right, but not the obligation, to modify, suspend, or cancel that portion of the Promotion and will award prizes as set forth above.
e. For those viewing/listening to the Station stream on the Internet or other non-broadcast means: Please be advised that you may be listening to a delayed stream of the broadcast signal, which may vary depending on your computer’s memory capacity and your connection. For that reason, we strongly recommend that you turn on your radio to the Station to participate in this or any other call-in promotion to be sure you are participating in “real time.” The Station assumes no responsibility for entrants not making timely phone calls to the Station as a result of the delays in the method of listening.
f. The Released Parties are not responsible for (i) typographical or other errors in the printing, the offering or the administration of the Promotion, or in the announcement of a prize; (ii) entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties, malfunctions, disconnections, other technological failures, telephone service outages, delays, dropped calls, or busy signals; or any other difficulties that may prevent an individual from entering or participating, or (iii) lost, stolen, mangled, misdelivered, misdirected, illegible, incomplete, incorrect, or late entries. Further, the Released Parties are not responsible if any part of a Promotion prize cannot be awarded due to acts of God, acts of war, natural disaster, weather, acts of terrorism or other factors beyond the Station’s control.
g. To obtain a copy of the Official Rules or a list of winners following completion of the Promotion, send a self-addressed, stamped envelope (VT residents may omit return postage) specifying “Official Rules” or “Winners List” to Classic Hits 93.1 WNOX Make it Easy to Take it Easy Giveaway Winner List or Official Rules Request, 93.1 WNOX-FM 1533 Amherst Rd. Knoxville TN, 37909. A copy of the Official Rules and a list of winners (when complete) are also available during regular business hours at 93.1 WNOX, 1533 Amherst Rd. Knoxville TN, 37909. All such requests must be received within 30 days following completion of the Promotion.
